2. Definitions

  • Website means https://arasys.co.id and all pages, features, content, forms, and information available on it.
  • Services means all products, services, technical support, customer support, systems, applications, consultations, procurement, installation, maintenance, and business activities provided by Arasys.
  • User means any individual, prospective customer, customer, partner, company representative, organization, institution, or other party accessing the website, using services, or communicating with Arasys.
  • Official Channels means websites, email, telephone numbers, WhatsApp, Instagram, Facebook, live chat, Chatwoot, or other communication media officially used by Arasys.
  • User Content means messages, comments, documents, images, videos, data, information, instructions, requests, or other materials submitted by users to Arasys.
  • Meta Platform means services owned by or related to Meta, including Instagram, Facebook, Messenger, WhatsApp, Meta Business, Meta Developer, and related APIs.

3. Scope of Website and Services

The website is provided for information regarding the company, services, portfolio, publications, official communication, and other features supporting Arasys business activities.

Arasys may provide services including:

  • Information technology consultation.
  • Website, application, information system, automation, and digital integration development.
  • Installation, configuration, procurement, maintenance, and repair of devices or systems.
  • Network, server, cloud, security, monitoring, and IT infrastructure services.
  • Customer support through Chatwoot, Instagram, Facebook Messenger, WhatsApp, email, website, and other official channels.
  • Quotations, orders, invoices, contracts, administration, technical support, and after-sales services.

4. Use of Website

Users agree to use the website reasonably, lawfully, and without disrupting the security, stability, or availability of the website.

We reserve the right to change, add, update, restrict, disable, or discontinue part or all website features at any time, either temporarily or permanently, to the extent permitted by law.

5. Use of Official Communication Channels

Users may contact us through available official channels. We will make reasonable efforts to respond within a reasonable time, depending on operating hours, service priority, request queue, issue complexity, and team availability.

Users understand and agree that:

  • Messages sent through Instagram, Facebook, WhatsApp, email, website, live chat, or other channels may be managed through customer support systems such as Chatwoot.
  • Conversation history may be stored for follow-up, communication evidence, audit, service improvement, dispute resolution, and legal compliance.
  • We may request additional information to verify identity, understand requests, resolve issues, or continue services.
  • Users must not send unsolicited confidential information such as passwords, PINs, OTP codes, or credentials through general conversation channels.

6. Services Through Instagram, Facebook, and Meta Platform

If users interact with Arasys through Instagram, Facebook, Messenger, or other Meta Platforms, users are also subject to the terms, policies, and rules of those platforms.

We use access to Meta Platform only for reasonable purposes, including:

  • Receiving messages from users.
  • Reading messages sent to our official accounts.
  • Managing conversations through customer support systems.
  • Responding to user messages through the same channel.
  • Providing service information, customer support, follow-up, and communication administration.

We are not responsible for disruptions, restrictions, delays, API changes, message delivery failures, account limitations, app reviews, permission denials, policy changes, or other actions taken by Meta, Instagram, Facebook, Messenger, WhatsApp, or other third-party platforms.

7. Integration with Chatwoot and Third-Party Systems

In providing customer support and business communication, we may use or integrate with third-party systems, including Chatwoot, Meta, Instagram, Facebook, WhatsApp, email providers, hosting providers, payment providers, cloud providers, security systems, analytics, anti-spam services, and other technical vendors.

8. User Obligations

Users must:

  • Provide true, accurate, complete, and non-misleading information.
  • Use the website, services, and communication channels lawfully and reasonably.
  • Maintain the confidentiality of their own accounts, passwords, OTP codes, tokens, credentials, and sensitive information.
  • Not send data or instructions that may harm systems, other users, Arasys, or third parties.
  • Not use the services for illegal activities, fraud, spam, system manipulation, intellectual property infringement, or privacy violations.
  • Ensure that any submitted data, documents, images, videos, instructions, or content is lawful and does not violate the rights of others.
  • Fulfill payment, administrative, and work approval obligations according to applicable transaction documents.

9. Prohibited Use

Users are prohibited from:

  • Using the website or services for unlawful purposes.
  • Attempting to access systems, servers, accounts, data, APIs, or infrastructure without authorization.
  • Conducting hacking, brute force, unauthorized scraping, reverse engineering, exploitation of security vulnerabilities, or system attacks.
  • Sending spam, malware, viruses, harmful scripts, phishing, fraudulent content, or harmful content.

10. User Content

Users are fully responsible for User Content submitted to Arasys, including messages, comments, documents, images, videos, data, instructions, and other attachments.

By submitting User Content to us, users represent that they have the lawful rights, permissions, or authority to submit such content and that the content does not violate the law, intellectual property rights, privacy, confidentiality, or rights of others.

11. Intellectual Property Rights

All content on the website and materials created by Arasys, including texts, designs, logos, trademarks, images, documents, page structures, publication materials, proposals, presentations, systems, applications, source codes, databases, workflows, methods, concepts, templates, and other materials, are owned by PT Arasys Inovasi Indonesia or lawful license holders.

Users are not permitted to copy, distribute, modify, sell, rent, republish, decompile, imitate, or use Arasys materials without written permission.

12. Quotations, Prices, Payments, and Transactions

Information regarding prices, products, services, estimates, and availability may change at any time unless agreed in writing in official documents such as proposals, invoices, purchase orders, contracts, MoUs, SLAs, or other cooperation documents.

Payment terms, taxes, additional costs, down payments, milestones, cancellation, work scope, warranties, quotation validity, and other administrative terms shall follow the transaction documents agreed by the parties.

13. Warranty, Support, and Service Limitations

Warranty, technical support, maintenance, SLA, or after-sales services only apply if stated in writing in the relevant transaction documents or agreements.

Warranty or support does not cover issues arising from:

  • Misuse, negligence, or changes made by users or other parties.
  • Electrical, network, device, server, or infrastructure issues outside Arasys control.
  • Malware, cyberattacks, credential leaks, or unauthorized access not caused by Arasys direct negligence.
  • Policy, API, feature, pricing, or restriction changes from third parties.
  • Force majeure or events beyond Arasys reasonable control.
  • Use of services outside the agreed scope.

14. Confidentiality

The parties must maintain the confidentiality of confidential information, including business data, technical data, customer data, quotation documents, special prices, configurations, system access, credentials, strategies, and other information reasonably considered confidential.

15. Website and Service Availability

We make reasonable efforts to keep the website and services available and functioning properly. However, the website and services are provided as is and as available.

We do not guarantee that the website or services will always be free from errors, disruptions, delays, data loss, security vulnerabilities, or harmful components.

16. Disclaimer

The website and the information contained in it are provided for general and informational purposes. Although we make reasonable efforts to keep information accurate and up to date, we do not guarantee that all information is always complete, accurate, error-free, or suitable for a particular purpose.

To the extent permitted by law, PT Arasys Inovasi Indonesia shall not be liable for direct or indirect losses, loss of profits, data loss, business interruption, reputational damage, third-party claims, recovery costs, loss of opportunities, or other consequential damages arising from the use of the website, use of services, system disruptions, third-party content, user errors, third-party services, or events beyond our control.

Our liability, if any and legally proven, is limited to the value of the service directly related to the disputed issue, unless otherwise required by law or applicable written agreement.

18. Privacy and Data Protection

The use of users’ personal data is governed by our Privacy Policy and forms an integral part of these Terms of Service.

19. Force Majeure

Arasys shall not be responsible for delays, failures, disruptions, or non-performance caused by events beyond Arasys reasonable control, including natural disasters, fire, flood, earthquake, power outages, internet disruptions, war, riots, pandemics, government policies, third-party service provider disruptions, large-scale cyberattacks, regulatory changes, or other events that cannot reasonably be prevented.

20. Changes to These Terms of Service

These Terms of Service may be updated from time to time to reflect changes in services, law, technology, platform policies, or operational needs. Changes are effective when published on our website or official channels.

21. Governing Law and Dispute Resolution

This document is governed by the applicable laws of the Republic of Indonesia.

In the event of a dispute, the parties agree to first resolve it amicably and in good faith. If no amicable resolution is reached, the dispute may be resolved through the competent dispute resolution forum in accordance with applicable Indonesian law, unless the parties agree to another forum in writing.
